The T&Cs for Hire

Thank you for choosing Fox and Hart (ABN: 61 765 114 554) for your event or wedding. These Terms and Conditions govern the hire and use of Fox and Hart items. Hereafter when we say “you. Your” etc, we mean the person hiring our items and services” When we say “our, we, us, site” etc, we mean Fox and Hart.

Collection and pickup

• Booking is for a 4-day hire period. Surcharges may apply if extra days are needed. Goods are to be collected on Friday and returned Monday. Mid week orders are welcome and pick up and drop off days can be arranged at our discretion.

Payment

• Full payment (including bond) is due one month prior to your booking or upon receipt within one month of booking. 
• A bond deposit is required for all bookings. This is payable on issue of your invoice and fully refundable upon return, provided the item is in the same condition. Bond deposit amounts are outlined below:
• Orders under $100 require a $100 bond payment. 
• Orders $100 - $249 require a $200 bond payment.
• Orders over $250 - $499 require a $300 bond payment 
• Orders over $500+ require a $400 bond payment 
• EFTPOS, cash or Bank Transfer is available with details listed on your invoice.
• Your items are not considered hired or held for you until such time as your deposit is paid.
• Any items can be added to booking at any time if that said item is available for hire. 
• Should you wish to pay your deposit outside this time, please contact us to check that all items are still available.
• Your items will be held for seven days only. After seven days from the invoice date, the items will be available for hiring by other clients.
• Your agreement of these terms is given upon paying your deposit.

Responsibility, damages and liability

• All items are packaged with care upon client pick up. It is expected that the same care is given upon drop off of booked items.
• You are responsible for items when in your possession.
• You are deemed in possession of the items from the time of their collection until they are returned.
• You agree to bring any damages to our attention
• Responsibility cannot be transferred, whether this be to the venue, guests or strangers who damage or take the items whilst in your possession, you agree to pay all associated costs due to missing or damaged (chips, stains, tears, dents, scratches) items, or those that require cleaning, fixing or replacing products at time of return or by agreement.
• You will be notified of any costs associated with the restitution/replacement/repair/cleaning.
• If collection of goods is organised, it is your responsibility to ensure that all items are stacked together and ready for collection. If items are not together and left behind after collection, it is your responsibility to ensure the item is returned to us before the following week of bookings.
• Liquid and permanent chalk or paint markers are prohibited for use on our blackboard collection. If you have used them, funds will be deducted from your bond for the time and materials to repair them.
• Fox and Hart nor any of its employees or third party providers shall be liable for any direct, indirect, incidental, consequential, special, punitive, or any other damages relating to or resulting from your use or inability to use our items as directed.

Cancellations

• Any bookings placed with us that requires cancellation, please note the following:
• 31 days + with written notice, full payment will be refunded.
• 15 – 30 days with written notice, 50% of payment will be refunded.
• 14 days or less, strictly no refunds will be given.

Non-returned items and fees

• Should all items not be returned by the Monday following your event you agree to pay for continued hire fees, in addition to reimbursement fees to clients that have booked the items still in your possession. 
• If we do not hear from you within 7 days of their due return date, you give authority to waiver your rights to return your bond and will be required to pay for the replacement of the item.
• Individual items taken off from your booking 3 weeks or less from the pick up date will still be charged the hire price as this is due to the fact that the goods could not be supplied to another client.
